POLICIES


1. Scope of Services

We provide professional fashion design services which may include, but are not limited to:

  • Concept design and mood boards
  • Sketches and illustrations
  • Fabric sourcing and selection advice
  • Pattern making and garment specifications
  • Consultation for branding and collection development

The scope of work will be outlined in the project agreement and is subject to change based on mutual consent between the Client and our team.

2. Project Agreement and Fees

  • Quotation: A detailed estimate and timeline will be provided based on the Client's specific needs and requirements. The final quote will be confirmed before any work commences.
  • Payment Terms: A payment of 50% is required upon confirmation of the project. The remaining balance is due upon completion of the work or before the delivery of final designs.
  • Additional Fees: Any changes or additions to the scope of work after the initial agreement may incur additional charges, which will be communicated and agreed upon before proceeding.

3. Client Responsibilities

  • Timely Communication: The Client agrees to provide all necessary information, materials, and feedback in a timely manner to avoid delays. This includes reference images, fabric preferences, sketches, or any other relevant inputs.
  • Approval: The Client is responsible for reviewing and approving drafts, sketches, and concepts. Any feedback or changes must be provided in writing within 5 business days after receiving the designs. Failure to respond within the agreed timeframe may result in project delays.
  • Copyright and Usage Rights: The Client is responsible for obtaining the necessary permissions for any third-party materials (e.g., logos, images) provided to us for inclusion in the design process.

4. Intellectual Property

  • Ownership: Upon final payment, the Client will own the rights to the final design(s). However, we retain the right to showcase the designs in our portfolio, website, and promotional materials unless otherwise agreed.
  • Usage Rights: The Client agrees not to reproduce, modify, or sell designs created by us for any purposes other than what is explicitly agreed in the project contract. Any unauthorised use of the designs may result in legal action.

5. Revisions and Changes

  • Number of Revisions: 2 revisions will be allowed will be specified in the project agreement. Additional revisions may incur extra fees.
  • Design Process: Once the design concept is approved, no further significant changes to the design or materials will be made unless agreed upon in writing and may incur additional charges.

6. Confidentiality

We are committed to protecting the confidentiality of any proprietary or sensitive information shared by the Client. All materials and concepts created during the design process will remain confidential unless written consent is given for disclosure.

7. Cancellation and Termination

  • Client Cancellation: If the Client decides to cancel the project after work has commenced, the deposit is non-refundable. Any work completed up to the cancellation date will be invoiced and payable.
  • Designer Termination: We reserve the right to terminate the project if the Client fails to meet payment obligations or provide necessary materials and feedback. In such cases, any work completed will be invoiced, and no further work will be carried out.

8. Delivery and Timeline

We will make every effort to complete the design work within the agreed timeline. However, we are not responsible for delays caused by factors outside our control, such as client delays, supplier issues, or unforeseen circumstances. A timeline for delivery will be confirmed at the start of the project.

9. Limitation of Liability

While we strive to provide high-quality and professional design services, we are not responsible for any issues arising from the use of the designs in production or subsequent phases, including but not limited to manufacturing defects, material issues, or production delays.

10. Force Majeure

Neither party shall be held liable for any delays or failure to perform due to circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, strikes, or government restrictions.

11. Amendments to Terms

We reserve the right to update or amend these terms and conditions at any time. Clients will be notified of any changes, and continued use of our services will indicate acceptance of the updated terms.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of The United Kingdom. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts.
